Legal

Privacy Policy

How we handle your data: transparently, sparingly and in accordance with the requirements of Switzerland, Germany, Austria and Liechtenstein. This is a courtesy translation. The German version is legally binding.

1. What this policy is about

For us, protecting your personal data is part of professional diligence. This Privacy Policy explains which data we process when you use this website, what we use it for and what rights you have.

It is addressed to visitors from Switzerland, Germany, Austria and Liechtenstein. Depending on applicability, the relevant provisions are the Swiss Federal Act on Data Protection (revDSG) together with the Data Protection Ordinance, the EU General Data Protection Regulation (GDPR, DSGVO), the Austrian Data Protection Act (DSG) and the Liechtenstein Data Protection Act (DSG-FL).

For all data protection enquiries, you can reach us at the email address above.

3. Visiting the website

When the website is accessed, technically necessary data are processed, in particular the IP address, date and time of access, the page accessed, browser and operating system type and the referrer URL. These data arise during operation on the servers of our website platform and serve the operation, stability and security of the website.

The legal basis is our legitimate interest in a secure and functional website (Art. 6(1)(f) GDPR; Art. 31 para. 1 revDSG).

4. Contact, appointment and webinar requests

If you use our forms to request an initial consultation, register for a webinar or write to us, we process the information you enter: name, company, position, business email address, telephone number where provided, topic, preferred format, your message and any request for a confidentiality agreement.

The purpose is to respond to your enquiry, arrange an appointment and prepare a meeting. The legal bases are your consent (Art. 6(1)(a) GDPR), the performance of pre-contractual measures (Art. 6(1)(b) GDPR) and our legitimate interest in handling business enquiries (Art. 6(1)(f) GDPR). Under Swiss law, we rely on the principles of Art. 6 revDSG and, where necessary, on your consent.

For webinars, we use your details to send you dates and access details. We will only send you a newsletter or other promotional material if you have expressly consented to this.

5. Crisis Readiness Check

In the Crisis Readiness Check, you answer eight questions. The evaluation (score and rating) is displayed directly in your browser. Only if you submit the subsequent form are your answers, your score and your contact details transmitted to us, so that we can give you personal feedback. No automated individual decision-making with legal effect for you takes place.

6. Downloading the NIS2 factsheets

For downloading the factsheets, we collect your first name, last name, company, position, business email address, optionally your telephone number, and the documents selected. We use this information to provide you with the documents and to contact you on the subject, provided you have consented to this. The legal basis is your consent (Art. 6(1)(a) GDPR).

7. Telephone, email and WhatsApp

If you call us or send us an email, we process your details in order to respond. The WhatsApp buttons only open the WhatsApp service once you click on them. From that point on, the provider’s privacy terms (Meta group) apply, over which we have no influence. Please do not send confidential documents via WhatsApp. We exchange confidential information only via an agreed, suitable channel.

8. Cookies, analytics and tracking

To the best of our current knowledge, we do not use any analytics, marketing or advertising trackers on this website. Technically necessary functions may store or read data in your browser insofar as this is required for the operation of the website. Should we use analytics or marketing tools in future, we will inform you here and, where required, obtain your consent in advance.

9. Website platform, hosting and processors

This website is operated using the Onepage platform (onepage.io). The platform provides hosting, content delivery (including images and fonts via a content delivery network) and the storage of form entries. In the process, your IP address is transmitted to the respective servers. The platform operator acts as a processor (Auftragsbearbeiterin under Swiss law, Auftragsverarbeiterin under the GDPR) on the basis of corresponding contractual agreements.

Other service providers (for example for email, IT operations or appointment scheduling) receive data only insofar as this is necessary for the stated purposes and they are contractually bound to confidentiality and data protection. Data are passed on to partners from our expert network only if this is necessary for your enquiry and you have consented.

10. Disclosure abroad

We may transfer data to recipients in countries outside Switzerland or the EEA, in particular where service providers operate servers there. In such cases, we ensure an adequate level of data protection, for example by means of an adequacy decision, the European Commission’s standard contractual clauses with the adaptations required for Switzerland, or other appropriate safeguards.

11. Retention period

We process personal data only for as long as is necessary for the stated purposes. We delete enquiries that do not lead to further cooperation once they have been dealt with and no retention obligation applies. Statutory retention obligations, for example under the Swiss Code of Obligations, the German Commercial Code (HGB), the German Fiscal Code (Abgabenordnung) or the Austrian Federal Fiscal Code (Bundesabgabenordnung), remain unaffected.

12. Data security

We take appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access. Transmission between your browser and this website is encrypted. Nevertheless, complete security of data transmission over the internet cannot be guaranteed.

13. Your rights

Within the scope of the applicable law, you have the right of access, rectification, erasure, restriction of processing and data portability. Where we process data on the basis of your consent, you may withdraw it at any time with effect for the future. You may object to processing based on legitimate interests.

To exercise your rights, an email to info@future-intelligence.ch is sufficient. To protect your data, we may request proof of identity.

You also have the right to lodge a complaint with a supervisory authority:

Switzerland: Federal Data Protection and Information Commissioner (FDPIC, EDÖB), www.edoeb.admin.ch

Germany: the data protection supervisory authority responsible for your place of residence or your federal state, www.bfdi.bund.de

Austria: Data Protection Authority (Datenschutzbehörde), www.dsb.gv.at

Liechtenstein: Data Protection Authority of the Principality of Liechtenstein (Datenschutzstelle), www.datenschutzstelle.li

14. Obligation to provide data

Providing the data marked as required fields is necessary for us to process your enquiry. Without this information, we cannot respond to your enquiry.

15. Changes

We may amend this Privacy Policy, for example in the event of new functions or changes in the legal situation. The version published on this website at the time applies.
